Terms and Conditions

1.Agreement to terms

1.1   These Terms and Conditions govern your use of the ArtGuide web application (the Service) operated by UX LAB LIMITED, a company registered in New Zealand.

1.2   By accessing or using ArtGuide at art-guide.app, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

1.3   We may update these Terms and Conditions from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated terms.

2.Description of service

2.1   ArtGuide is an AI-powered audio guide web application that allows museum visitors to photograph artworks and receive spoken descriptions in multiple languages. The Service is provided via a web browser and does not require a separate app download.

2.2   The Service uses artificial intelligence to identify artworks and generate descriptions. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. ArtGuide is intended as a supplementary guide and not as an authoritative academic or curatorial resource.

3.Accounts and registration

3.1   You must create an account to use ArtGuide beyond the free trial. You can register using Google, Facebook, or a magic link sent to your email address.

3.2   You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.3   You must provide accurate information when creating your account and keep it up to date.

3.4   You must be at least 13 years of age to use the Service.

3.5   We reserve the right to suspend or terminate accounts that violate these Terms and Conditions.

4.Free trial and purchases

4.1 Free trial

4.1.1   New users receive 5 free artwork scans upon creating an account.

4.1.2   Free scans are non-transferable, cannot be accumulated across accounts, and do not carry monetary value.

4.2 Paid passes

4.2.1   After exhausting your free scans, you may purchase one of the following passes.

4.2.2   Day Pass at 4.90 euros provides 24 hours of unlimited scans from the time of purchase.

4.2.3   Weekly Pass at 9.90 euros provides 7 days of unlimited scans from the time of purchase.

4.3 Payment

4.3.1   All payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service.

4.3.2   Prices are displayed in Euros (EUR) and may be subject to local taxes depending on your location.

4.4 Refund policy

4.4.1   Due to the digital and immediately-consumed nature of our Service, all purchases are final and non-refundable once a pass has been activated and used to perform scans.

4.4.2   If you experience a technical issue that prevents you from using a pass you have purchased, please contact us at uxlab.nz@gmail.com within 48 hours of purchase. We will review your case on its merits.

5.Acceptable use

5.1   You agree to use ArtGuide only for lawful purposes and in a way that does not infringe the rights of others.

5.2   You must not use the Service for any commercial purpose without our prior written consent.

5.3   You must not attempt to circumvent the scan limit or free trial through any technical or other means.

5.4   You must not upload images that contain illegal content, or use the Service to process images in a way that violates applicable law.

5.5   You must not attempt to reverse engineer, decompile, or extract the source code of the Service.

5.6   You must not use automated scripts or bots to interact with the Service.

5.7   You must not interfere with or disrupt the integrity or performance of the Service.

5.8   You must not attempt to gain unauthorised access to any part of the Service or its related systems.

6.Intellectual property

6.1 Our intellectual property

6.1.1   The ArtGuide name, logo, web application, and all related content created by us are the intellectual property of UX LAB LIMITED. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.

6.2 User content

6.2.1   When you upload images to ArtGuide, you retain ownership of those images.

6.2.2   By uploading an image, you grant us a limited, non-exclusive licence to process that image through our AI pipeline solely for the purpose of providing you with the Service.

6.3 AI-generated content

6.3.1   The audio descriptions and scripts generated by ArtGuide are created by AI and are provided for personal, non-commercial use only. You may not reproduce or distribute AI-generated content from ArtGuide for commercial purposes.

6.4 Third-party content

6.4.1   ArtGuide generates descriptions of artworks, many of which are in the public domain. Where artworks are still under copyright, our descriptions constitute commentary and criticism for educational purposes. ArtGuide does not reproduce copyrighted artwork images.

7.AI accuracy disclaimer

7.1   ArtGuide uses artificial intelligence to identify artworks and generate descriptions. You acknowledge that AI identification may not always be accurate, particularly for lesser-known or regional artworks.

7.2   AI-generated descriptions are provided for informational and entertainment purposes and may contain factual errors.

7.3   ArtGuide is not a substitute for authoritative museum information, academic resources, or professional art historical guidance.

7.4   We display confidence indicators to help you assess the reliability of identifications, but these are estimates and not guarantees of accuracy.

7.5   We are not liable for any decisions made or actions taken in reliance on AI-generated content from ArtGuide.

8.Third-party services

8.1   ArtGuide integrates with third-party services to operate, including OpenAI for artwork identification and description generation, Stripe for payment processing, Google and Facebook for social authentication, Supabase for data storage, and Google Analytics for usage analytics.

8.2   Your use of these third-party services through ArtGuide is subject to their respective terms of service and privacy policies.

8.3   We are not responsible for the practices of third-party services.

9.Limitation of liability

9.1   To the fullest extent permitted by applicable law, UX LAB LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

9.2   Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9.3   Nothing in these Terms and Conditions limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10.Indemnification

10.1   You agree to indemnify and hold harmless UX LAB LIMITED and its officers, directors, employees, and agents from any claims, damages, losses, or expenses including legal fees arising from your use of the Service, your violation of these Terms and Conditions, or your violation of any third-party rights.

11.Service availability

11.1   We aim to provide a reliable Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

11.2   We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

11.3   We are not liable for any inconvenience or loss caused by Service interruptions.

12.Museum policies

12.1   You are responsible for complying with the photography and device policies of any museum you visit. ArtGuide is not affiliated with any museum and has no authority over museum rules.

12.2   We are not liable for any consequences arising from your use of ArtGuide in a museum that prohibits photography or digital devices.

13.Governing law

13.1   These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising from these Terms and Conditions or your use of the Service will be subject to the exclusive jurisdiction of the courts of New Zealand.

13.2   If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

14.Severability

14.1   If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary. The remaining provisions will continue in full force and effect.
